Elon Musk is absolutely cooking Sam Altman and OpenAI in court, and it’s about time. These frauds hijacked the non-profit, open-source mission Elon helped create, turned it into a greedy closed-source profit cult, and are now sprinting toward god-like AGI with zero safety, zero honesty, and zero integrity. Sam went full villain arc: lied to the world, lied to regulators, lied to his own co-founders. Suing them isn’t just justified, it’s necessary. The Musk versus Altman trial just dropped bombshell texts from 2023 showing him begging and pleading like a lost puppy after the OpenAI board kicked him out. He texted Mira Murati in panic: Can I come in and talk? Why did they change their mind? Can you stall? Still don't want me? Her cold reply: They don't want you. New guy is rando twitch guy. The board did not care if everyone quit. It would not matter. This is OpenAI. A deceptive leader who sowed chaos. No backbone. No vision. Elon Musk left when they betrayed it. The case against OpenAI is getting markedly stronger now that Musk is off the stand. Why? Musk’s lawyer is interrogating OpenAI founder Greg Brockman, making clear that OpenAI sold its mission as a nonprofit for public benefit, and not just to Elon but to many big figures in Silicon Valley, seeking *donations* to establish the company as a nonprofit. This case is *not about Elon*. It’s about the bait and switch that OpenAI pulled, raising money as a nonprofit and then switching after ChatGPT hit bit. Yes, the company misled Elon, but also misled many many others, from the state of California to other early “donors”, to early employees and the public. The question is whether that is ok.

The IPO is the cash-out. California charitable-trust law calls this self-dealing.

🚨UPDATE: Judge just DENIED OpenAI's motion from the bench Her reasoning: OpenAI should have asked Musk about it while they had him on the stand. Same critique I just posted. The motion was a tactical play to put a private message in front of the jury without Musk getting to address it. The judge saw exactly that. The "Musk threat" headlines from this morning are now stories about a denied motion.

🚨 OpenAI's lawyers filed a motion asking the judge to allow Brockman to testify in front of the jury with a verbal recollection of a settlement message between him and Musk >Musk reached out to gauge interest in settlement >Brockman proposed both sides drop their claims >Musk refused surrender: "By the end of this week, you and Sam will be the most hated men in America. If you insist, so it will be." The mainstream news is leaving out what the filing actually says: OpenAI is NOT asking to introduce the screenshot. They want only Brockman's verbal recollection, not the actual exchange. Why verbal, not screenshot? OpenAI's lawyers are trying to play the victim card by putting Brockman on the stand today with a sympathetic story. Brockman is the same defendant whose November 2017 private diary read: "I cannot believe that we committed to non-profit if three months later we're doing b-corp then it was a lie." Brockman is the person who emailed Musk "honor to work alongside you" six weeks after writing in private that they were planning to oust him. The defense is trying to substitute emotion for evidence because they have no direct evidence Musk's lawsuit is competitive warfare. The anti-competitive frame is the ONLY frame OpenAI has left, because the structural-equity case is what they cannot answer, so they are reaching for tactics.

This is unjust enrichment, captured in his own testimony.

OpenAI's lawyers' plan was to use this to argue Musk's lawsuit is competitive warfare — he was offered for-profit equity, refused only because he wanted control. Musk on the stand today: >"How can I have equity in a non-profit?" That single sentence inverts the defense exhibit. If OpenAI offered Musk equity, OpenAI was already operating like a for-profit. The $1B was a COLLECTIVE pledge from nine contributors. OpenAI's lawyer collapsed a collective pledge into a personal commitment to make Musk look like a dishonest man who broke his promise. The attack works on the headline. The factual record undermines it.
