It should not be cut and dry, Yes or No. Here is my reasoning: Back in the 70's a man was shot and killed breaking into a home. Turns out he had Alzheimers. He had walked out of his home as his wife slept. He walked several blocks and broke into the home of a family that was living in the house he had lived in for many years. He wasn't aggressive or armed. He was just confused. I think people should be given the DUTY of intent. You should have to make the life and death choice based on your interpretation of the intent of the individual. I am not saying prosecution should be based on your flawed interpretation but you should be able to justify why you made the decision to shoot.
