The Court of Appeal has significantly reduced the sentence of Edward Kigere, a man who in September 2014 defiled a 4 year old, was arrested soon after, tried and convicted in January 2018.
He was 30 years old when he lured a 4 year old neighborhood child-who’d just returned from school-with promises of chapati, took her away from her home and defiled her.
The High Court convicted him of aggravated defilement and the Learned Trial Judge sentenced him to 35 years, less 3 years and 3 months of time served on remand, which brought the sentence to 31 years and 9 months.
The sentence range for the offense is 30 years to death.
The man appealed the sentence, saying it was manifestly harsh and excessive. He also claimed the trial Judge didn’t count 2 weeks of time served before he was arraigned in court.
He told court that he’s a first time offender, a relatively young father of three little children and has family responsibilities.
Upon evaluating the facts of the case, the Court of Appeal found that “while the offence remains serious and deserving of
condemnation, the totality of the circumstances does not justiff a sentence at the higher end of the spectrum reflected in the authorities cited by the Respondent (the state).”
The Court set aside the 35 year sentence and substituted it with 12 year imprisonment, which when you take into consideration time already served, means this man just has one more year in jail before he comes back to the free world.
Is our justice system just too lenient on defilement?

In my neighborhood, I’ve seen little girls as young as 13, or even younger raising babies that aren’t theirs, washing piles of clothes bigger than them, and cooking for entire households instead of simply being children.
And what keeps disturbing me is this: when did we start seeing this as normal?
