Let’s be clear: Premier Doug Ford’s last minute attempt at seeking an injunction against the Al Quds Day protest was set up to fail. There simply wasn’t enough time to build the evidentiary record needed to justify court intervention. Nor was it fair to require the respondent to file materials without first seeing what evidence the province was relying on. The province was also unable to cross-examine organizers who provided sworn statements on behalf of the Al Quds Day Committee, including Rabbi David Mivasair and Movement Media Hub executive director Gur Tsabar. Additionally, the province could have sought evidence from the city regarding the apparent lack of a permit for a demonstration blocking major arterial roads. Would the outcome have been different with more time to prepare?
