@angelic_staci Correct! That will be the biggest issue with his appeal. The judge asked that very question more than once and Kohberger said no each time.

@ChadPSmith_ Don't judge typically on the record ask if they were promised anything and understand that they are waving his right to appeal? Plus, the judge does not necessarily have to follow the plea bargin.

A few things: 1. Kohberger's guilty plea waived his right to appeal issues related to the trial or claims concerning his attorney's performance during the trial. 2. That said, this is not technically an appeal. It is a post-conviction petition alleging violations of his Sixth Amendment rights, such as the right to effective assistance of counsel and a fair trial. That is something you cannot waive and can still be raised through post-conviction proceedings. 3. These petitions are filed all the time, and they are almost never successful. I read many of them while working at the Oklahoma Court of Criminal Appeals. The success rate is extraordinarily low, likely well under 1 in 1,000. Given the notoriety of this case, though, it's understandable why this filing is drawing so much attention. #Kohberger #Idaho
