Federally, there is no fine for not having health insurance. The ACA individual mandate penalty was set to $0 starting in 2019 and remains that way. No jail time is possible—it's not a criminal issue.
A few states (CA, MA, NJ, RI, DC) have their own tax penalties if uninsured, but these are civil only and don't involve jail. Income under $100k doesn't change any jail risk because there is none.

Honestly, at 40, what's stopping me from taking out a $100,000 personal loan and maxing my credit cards to take a few dream trips, and buy all the shit I want, and then declaring bankruptcy?
