@multitalentfrey Schlimmer finde ich ohnehin, dass die Rspr. Cannabis in der Sache noch wie ein BtM behandelt, etwa bei der "nicht geringen Menge". Der sprachliche Schnitzer ist also synchron mit der Haltung.

Auch mehr als zwei Jahre, nachdem Cannabis aus dem BtMG herausgenommen worden ist, bleibt es für den BGH ein "Betäubungsmittel" (2 StR 780/25 Rn. 4 f.).

Bundesdrogenbeauftragter Streeck (CDU) spricht sich für Pilotprojekte zum legalen Cannabisverkauf aus. Als erster Unionspolitiker überhaupt.
Seine Begründung ist nüchtern: Rund 5 Millionen Menschen konsumieren regelmäßig Cannabis. Wer das ignoriert, schafft keine Kontrolle, sondern Ausweichverhalten.
Genau das sehen wir täglich. Solange es keine funktionierende zweite Säule mit regulierten Fachgeschäften gibt, weichen Konsumenten auf den Graumarkt aus oder auf medizinische Wege, die dafür nicht gedacht sind.
Eine stabile Patientenversorgung und ein geregelter Freizeitmarkt schließen sich nicht aus.

The standard being set is high. Not: "was there other evidence?" Not: "did you trust the source?" But: genuine scrutiny. Was there a fair trial? Real equality of arms? Adequate reasoning? Complete datasets? Verifiable authenticity?
