Some people arguing the commander-in-chief has final say. He does not. Under 18 U.S.C. § 3056 the Secret Service has full authority in an emergency. It’s so complete it has a legal doctrine called “owning the body” where in an emergency, the physical body of the cabinet members and President are assets of the United States. The Secret Service may physically move, detain, restrain or relocate any member in the line of succession, against their will and command, during an emergency. The President’s orders cannot stop or overrule that. They cannot have their job jeopardized or reprimanded for any action done to physically protect the President or the cabinet even if it was against the will of that member, so long as it was done in the name of safety. During that emergency, the cabinet is legally deemed to lose autonomy over their physical body and freedom of movement so long as the violations of that autonomy are related to physical safety. The President cannot just “decide” to stay or command to stay. They will drag him kicking and screaming if they have to.

The Secret Service doesn’t give you a choice. For decades we’ve seen in EVERY case where there has been a Presidential security breach, they tackle you, shove you, hell they will carry the President kicking and screaming if they have to. But twice now with Trump, they’ve shrugged and let him get his photo op or return to the stage?
