Court Suspends BAE173 Doha's Exclusive Contract... "Relationship of Trust Broken" tl;dr: The court has suspended Doha's (BAE173) contract with PocketDol Studio, ruling that the agency's failure to provide transparent settlement data effectively destroyed the necessary relationship of trust. Doha is now free to pursue independent activities. "The court has accepted the application for an injunction to suspend the effectiveness of the exclusive contract filed by Doha (real name Na Gyumin), a member of the idol group BAE173, against his agency. On the 16th, the 50th Civil Division of the Seoul Central District Court (Presiding Judge Lee Sang-hoon) granted the injunction to suspend the effectiveness of the exclusive contract filed by Doha’s side against PocketDol Studio. The court suspended the effectiveness of the exclusive contract signed between Doha and the agency in April 2020 and ruled that the agency must not interfere with Doha's entertainment activities or restrict him from entering into contracts with third parties. The court also ordered PocketDol Studio to bear the litigation costs. The court found that the fact that the agency failed to provide settlement data despite Doha's request in September last year broke the relationship of trust. Regarding the settlement of profits specifically, the court ruled, "Transparent and faithful distribution of profits is an essential prerequisite for the continuation of a relationship of trust. In order for the creditor (Doha) to verify whether the profit distribution carried out by the debtor (PocketDol Studio) is appropriate, it is necessary for him to directly examine the settlement statements and supporting data." The court continued, "Regardless of whether an actual payment amount exists as a result of the settlement, the agency bears the obligation to provide settlement statements detailing income and expenditures, as well as the supporting data that serves as the basis for those statements." Furthermore, the court pointed out that if the main lawsuit were to be prolonged, Doha's independent entertainment activities would be significantly restricted, which could lead to an infringement of fundamental constitutional rights, such as the freedom to choose an occupation. As a result, Doha is now able to engage in independent entertainment activities without being bound by the exclusive contract. The injunction takes effect from the moment the decision is served. Attorney Heo Seonghoon of the law firm LIWU, the legal representative for Doha, stated, "This ruling confirms that the fulfillment of transparent settlement obligations is the most important duty of an agency in an exclusive contract relationship. We welcome the court's wise decision, and as the main lawsuit will now proceed in earnest, we plan to reveal the issues regarding the unfair settlement history that has occurred in the meantime, one by one."
