I am being pressured to accept the 26th Constitutional Amendment, yet my entire struggle has been for the rule of law, and this amendment blatantly violates it. They demand that I apologize for May 9th (2023). Yet those who owe the nation an apology are the ones who stole CCTV footage, dishonored women, desecrated homes, imprisoned thousands of political workers, and martyred innocent citizens. If even one hour of the May 9th cases were heard on merit, these baseless cases would collapse instantly. The tragedy here is not only the absence of justice, but that not even a semblance of justice is visible. Nations do not perish under oppression. They are reborn through struggle. The Holy Prophet (Peace Be Upon Him) endured thirteen of the most difficult years but remained steadfast and was ultimately triumphant. Therefore, following in his footsteps, we too must stand firm as a nation and fight until the very end. Peaceful protest becomes the only viable path when every door to justice is sealed shut. I call upon the entire nation, including Pakistan Tehreek-e-Insaf, to prepare for a nationwide protest. Rule of law is entirely suspended in Pakistan. Even the dignity of women is no longer secure. My wife, Bushra Bibi, has been in solitary confinement for 14 months over mere allegations of facilitation, without a single proven charge. Dr. Yasmin Rashid, a cancer survivor and an elderly woman, has been shamelessly jailed under false cases. My sisters, aged between 65 and 70, visit me in jail under High Court orders, which is a basic right, but a Colonel obstructs them, flouting court directives with impunity. My sisters are abducted and abandoned in remote areas in the dead of night. A nation that treats its own women this way has lost its moral compass. When Maryam Nawaz was found guilty of owning five undisclosed flats in London, her bail was granted within two months, because the Sharif family had agreed to a deal. Anyone who bows before tyranny gets absolved of all charges, while those who stand on principle are punished without cause. No foreign investment has come into Pakistan for two years because the world knows that the law here is trampled under a Colonel’s boot. Without investment, there can neither be no economic stability nor development. Investor confidence will remain non-existent as long as judicial orders remain subject to a Colonel’s whims. The entire nation now looks to the judiciary for justice yet the 26th Amendment has crippled the judiciary. There are two motives behind this amendment: The first is to protect a rigged election. And secondly, to keep me, PTI leadership, and its workers incarcerated, violating basic human rights without fear of accountability. There are two direct consequences of this Amendment: 1- The judiciary has entirely surrendered to the executive. The Supreme Court has authorized military courts in direct contradiction of Article 175(3) of the Constitution, which mandates a separation of powers. Special benches are being formed to snatch reserved seats from PTI despite the people voting for us. These seats are being handed to other parties in complete violation of the Constitution. 2- The judiciary is so paralyzed that even High Courts and judges cannot assign cases of their own volition. As a result, I am being denied justice. Sometimes benches for my cases remain incomplete, while hearings are arbitrarily delayed at other times. My cases are deliberately kept in limbo. Even my basic rights under jail regulations are denied—I am not allowed to speak to my children, scheduled meetings with my wife are cancelled, and even my books are withheld. All of this is designed to break my spirit. 1/2

“مجھے دو سال پہلے کہا گیا کہ تین سال کے لیے پیچھے ہٹ جاؤں اور موجودہ نظام کو چلنے دوں، لیکن میں کسی یزید کے کہنے پر تین سال تو کیا تین منٹ بھی خاموش نہیں رہوں گا۔ مجھ پر چھبیسویں ترمیم کو قبول کرنے کا بھی زور ڈالا جا رہا ہے لیکن میری جدوجہد ہی قانون کی حکمرانی کی ہے اور چھبیسویں آئینی ترمیم عین اس کے منافی ہے۔ مجھ سے نو مئی کی معافی مانگنے کا مطالبہ کیا جاتا ہے مگر معافی وہ لوگ مانگیں جنہوں نے سی سی ٹی وی فوٹیج چرائی ہے، جنہوں نے عورتوں کی عزتیں پامال کیں، لوگوں کے گھروں کا تقدس برباد کیا، ہزاروں سیاسی ورکروں کو جیلوں اور عقوبت خانوں میں ڈالا اور بے گناہ لوگوں کو شہید کیا۔ نو مئی کے کیسز کی ایک گھنٹہ بھی میرٹ پر سماعت ہو تو یہ بےبنیاد مقدمات فوری ختم ہو جائیں گے، لیکن المیہ یہ ہے کہ یہاں انصاف ہونا تو دور کی بات انصاف ہوتا نظر بھی نہیں آ رہا۔ ظلم سے قومیں کبھی ختم نہیں ہوتیں بلکہ نئے سرے سے بنتی ہیں۔ نبی اکرم ﷺ نے 13 سال مشکل ترین وقت کاٹا لیکن آپ ﷺ ڈٹے رہے اور بالآخر سرخرو ہوئے۔ لہٰذا ہم سب کو آپ ﷺ کے نقش قدم پر چلتے ہوئے بحیثیت قوم ڈٹ کر آخری دم تک مقابلہ کرنا ہوگا۔ جب انصاف کا ہر دروازہ بند کر دیا جائے پھر پر امن احتجاج کے سوا کوئی راستہ نہیں بچتا۔ تحریک انصاف سمیت پوری قوم کو پیغام دیتا ہوں کہ ملک گیر احتجاج کے لیے تیار رہیں۔ پاکستان میں قانون مکمل طور پر معطل ہے۔ یہاں عورتوں کی بھی عزت محفوظ نہیں ہے۔ میری اہلیہ بشریٰ بیگم صرف سہولت کاری کے الزام میں 14 ماہ سے قید تنہائی میں ہیں حالانکہ ان پر جرم ثابت بھی نہیں ہوا۔ ڈاکٹر یاسمین راشد کینسر سروائیور اور بزرگ خاتون ہیں مگر ان کو بھی بے شرمی سے جعلی مقدمات میں پابند سلاسل کیا گیا ہے۔ میری ہمشیرگان، جن کی عمریں 65 سے 70 سال کے درمیان ہیں، ہائی کورٹ کے حکم پر جیل مجھ سے ملنے آتی ہیں جو ان کا اور میرا بنیادی حق ہے مگر ایک کرنل ان کو روک دیتا ہے اور عدالت کا حکم ردی کی ٹوکری کی نذر ہو جاتا ہے۔ جنگل کے قانون کا یہ عالم ہے کہ میری بہنوں کو یہاں سے گرفتار کیا جاتا ہے اور چکری کے پاس آدھی رات کو لے جا کر بے یارو مددگار چھوڑ دیا جاتا ہے۔ جس ملک میں اپنی ہی خواتین کے ساتھ ایسا سلوک ہو وہاں کا اخلاقی معیار فوت ہو چکا ہے۔ مریم نواز کے لندن میں 5 فلیٹس نکلے تھے مگر ان کی ضمانت دو ماہ میں ہی ہو گئی تھی کیونکہ شریف خاندان ڈیل پر راضی تھا۔ جو فرعونیت کے آگے جھک جاتا ہے اس کے سب کیس معاف ہیں مگر جو حق پر کھڑا ہو وہ بے جرم بھی سزاوار ٹھہرتا ہے۔ دو سال میں بیرون ملک سے کوئی سرمایہ کاری اسی لیے نہیں آ سکی کیونکہ دنیا جانتی ہے یہاں قانون ایک کرنل کے جوتے کی نوک پر ہے۔ یاد رہے کہ سرمایہ کاری کے بغیر نہ ملک میں معاشی استحکام آتا ہے اور نہ ہی معیشت ترقی کر سکتی ہے۔ جب تک عدالتی احکامات کرنل کے اشاروں کے محتاج ہوں گے تب تک سرمایہ کاروں کے لیے اعتماد کی فضا ناپید رہے گی۔ پوری قوم انصاف کے لیے عدلیہ کی طرف دیکھ رہی ہے۔ مگر چھبیسویں آئینی ترمیم کر کے عدلیہ کو مفلوج کر دیا گیا ہے۔ اس ترمیم کے پیچھے دو ہی وجوہات ہیں: ایک تو دھاندلی ذدہ الیکشن کا تحفظ کرنا، اور دوسرا مجھ سمیت تحریک انصاف کی لیڈر شپ و کارکنان کو جیل میں قید رکھنا اور احتساب کے خوف کے بغیر بنیادی انسانی حقوق کی خلاف ورزی کرنا۔ چھبیسویں آئینی ترمیم کے براہ راست دو نتائج نکلے ہیں: ۱: ایک یہ کہ عدلیہ نے اپنے آئینی و روایتی کردار کے برعکس انتظامیہ کے سامنے بالکل سرنڈر کر دیا ہے۔ ملٹری کورٹس کے حوالے سے سپریم کورٹ کا فیصلہ آئین کے آرٹیکل 175 (3) کے متصادم ہے جو کہتا ہے کہ عدلیہ انتظامیہ سے الگ ہے مگر یہاں اس آرٹیکل میں ترمیم کیے بغیر ہی ایگزیکٹو کو عدلیہ کے تمام اختیارات سونپ دیے گئے ہیں۔ ملٹری کورٹس کے ساتھ ساتھ مخصوص نشستوں پر بھی بینچ بنا کر تحریک انصاف سے یہ نشستیں چھیننے کی کوشش کی جا رہی ہے۔ ووٹ تحریک انصاف کو پڑا ہے مگر آئین کے بر خلاف یہ نشستیں دوسری جماعتوں کو دینے کی کوشش جاری ہے۔ ۲: دوسرا یہ کہ عدلیہ اس قدر مفلوج ہو چکی ہے کہ اعلیٰ عدلیہ اور جج اپنی مرضی سے مقدمات لگا ہی نہیں سکتے۔ نتیجتاً مجھے بھی عدالتوں سے انصاف نہیں مل رہا۔ کبھی میرے کیسز کے لیے بینچ مکمل نہیں ہوت تو کبھی سماعت نہیں ہوتی۔ جان بوجھ کر میرے مقدمات کو التواء میں رکھا جاتا ہے۔ میرے بنیادی انسانی حقوق بھی معطل ہیں۔ جیل مینوئل کے مطابق جو حقوق ایک عام قیدی کو حاصل ہوتے ہیں مجھے وہ بھی نہیں دئیے جا رہے۔ میرے بچوں سے میری بات نہیں کروائی جاتی، میری اہلیہ سے ہفتے میں ایک طے شدہ ملاقات بھی روک دی جاتی ہے اور تو اور میری کتابیں تک روک لی جاتی ہیں۔ یہ سب صرف اس لیے کیا جا رہا ہے تاکہ میں ٹوٹ جاؤں۔ 1/2

When one man made the decision behind closed doors to remove our govt and bring back the same cabal of crooks who had been plundering Pak for three decades, it resulted in our economy tanking and going into a tailspin. The statistics show that even an enemy could not have done more damage to the people of Pakistan like PDM has over the last one year. It is the worst economic performing year in our history.

I want to thank the government for putting my name on the ECL as I have no plans to travel abroad, because I neither have any properties or businesses abroad nor even a bank account outside the country. If and when I do get an opportunity for a holiday, it will be in our northern mountains, my favourite place on earth.
