The SC Senate killed a Democrat’s MMR mandate bill, then filed S.1029 as the ‘pro-freedom’ answer. But buried in the fine print is a significant expansion of state bureaucratic power. S.1029 hands the Department of Public Health general direction and supervision over vaccine exemptions statewide, plus new rule-making authority over those exemptions. That means the rules governing your right to opt out of vaccine requirements would be set by an administrative agency. Whatever the law allows today, DPH gets to define tomorrow. The bill also adds quarantine language specifically targeting unvaccinated children at private schools and childcare facilities. That language already exists elsewhere in state code. The decision to spell it out again here, in the specific context of children with exemptions, is not an accident. The personal exemption added for public school families does not come close to offsetting this. South Carolina’s existing religious exemption already covers most of the same ground.
