Today, I presented my oral argument in the anti-SLAPP motion I filed against Matthew Vickers. I had already won in-part on the tentative ruling. He was declared a public figure, and a big chunk of his case was knocked out. But we want the full win. OneTaste Inc. v. Netflix, Inc., 116 Cal. App.5th 174 (2025) was cited in my oral argument today. “a public figure’s conclusory ‘denials’ of s***** ******* ‘do not constitute proof of probable falsity’” and “does not alone establish malice.” Netflix was going to release a documentary on OneTaste, Inc that included allegations of s***** *******. OneTaste emails Netflix producer with a bunch of denials. Netflix made the documentary anyway and OneTaste sued. Netflix filed an Anti-SLAPP and it’s the exact same issue here: Is a public figure plaintiffs' denial of s***** ******* allegations sufficient to establish actual malice for purposes of the second prong of an anti-SLAPP motion? And the answer, according to that case (appellate case law in California) is NO. Because actual malice is a subjective standard. It is my hope that the very fair judge sides with me in-full on this matter. We shall see! Instead of ruling on the spot, he will take time to consider my citation here. I believe there's a real shot to prevail at this level instead of on appeal. I thank Your Honor again for hearing me out. Oh, and this is in no way meant to further the original statements that are being litigated, of course. I'd like to move on from all that, but it is my firm belief that I am in the legal "right" on this matter. 🫡
