Perhaps you’re a Bushy-establishment type in Austin, married to the lion of the Texas bar who’s on the road warning about the threat Donald Trump poses to our institutions. Who do you want with a say in your successor? John Cornyn or Ken Paxton? Let’s say you’re a different circuit judge in Texas. Perhaps you’re a Bushy-establishment type in Austin who’d like your seat to stay in Mississippi. Do you want to go now when John Cornyn will work with his ally Roger Wicker to keep the seat in Mississippi? Or do you want to wait for Ken Paxton to join Ted Cruz—perhaps on Judiciary!—to demand the seat be moved to Texas in a narrowly divided Senate? Paxton may lose. But he also may win! If Judges Richman and Southwick leave, well, now, they can avoid having him pick their replacements. Senate terms are long.
