SUSPECT vs ACCUSED PERSON vs CONVICT
These words are often used interchangeably in everyday conversation, but in law, they carry different meanings depending on the stage of a criminal matter.
SUSPECT
This is a person who is believed to have been involved in a crime but has not yet been charged in court.
Example:
Abu is arrested on suspicion of stealing Bayo's phone. He remains a suspect until the police conclude their investigation and file a charge in court.
No formal charge has been filed yet.
He is still presumed innocent until proven guilty by a court.
The police is very instrumental at this stage(Investigation stage).
ACCUSED PERSON
This is a person who has been formally charged in court for a criminal offence.
Example:
At the conclusion of police investigation, Abu is brought before a court and charged with stealing Bayo's phone.
The charge has been read in court.
He has taken his plea (Guilty or Not Guilty).
He is now standing trial.
He is expected to respond to the allegations against him in court.
He is still presumed innocent until proven guilty.
CONVICT
This is a person who has been found guilty by a court after a full trial.
At this stage, the court has heard from both sides, and both parties have closed their cases.
Example:
The court finds Abu guilty of stealing Bayo's phone and sentences him.
Guilt has been established beyond reasonable doubt.
Judgment has been delivered.
He becomes liable to punishment.
He will then face imprisonment for the offence of stealing.
