This week’s cancellation of the CDC’s ACIP meeting halted what would have been the first-ever federal review of COVID vaccine injuries at the CDC. Judge Brian Murphy blocked ACIP and all corresponding meetings because the proceedings and recommendations were deemed to be causing harm. For the COVID vaccine injured, the harm didn’t come from ACIP’s proceedings, it came from stopping them. Victor Simoes had his whole life ahead of him when he suffered a fatal aortic dissection. Leaving his grieving mother to seek out medical recognition and answers. With the meeting cancelled, this chance for help has ended. How long are patients expected to wait for help?

Interesting. HHS has TOTAL discretion over the membership requirement given it can simply update the charter - ACIP is authorized under broad FACA (meaning the Secretary has broad authority) and not expressly authorized by congress (which it has done with other committees - including specifying membership). So, if I was HHS, and wanted to quickly move forward, I’d update the charter and modify the membership requirements. Then, throw up a federal register notice soliciting nominations, and then appoint new members - which could potentially be all the previous members. Why fight a court case, which could take months, when you can quickly modify the charter and get to the outcome you want.
