@jscholt Perhaps we need to reconsider using the term political constitution altogether. I find it rather unhelpful.

@DrKatyBarnett It is unfortunately likely that SCOTUS will strike down any attempt by Congress to legislate on this by holding that it violates the commerce clause.

Wow. Why did Congress never enact legislation, and leave it to hinge on a SCOTUS ruling? Instead - both sides “stacked” SCOTUS with “their” people to change/keep the law. Um, you’re actually legislators, YOU can change the law? bbc.com/news/world-us-…

SCOTUS has some iconic footnotes. Fn 4 of Caroline Products is one. Fn 11 of Torasco v. Watkins is another. Both can be used to further progressive agendas. But, Fn 26 of Dobbs v. Jackson is absurd. To cite a gentleman's magazine from August 1732 is completely out of line.
