Imagine if you didn’t actually owe your servicer the mortgage payment. In 2025, we heard a lot about mortgage fraud, as in some elected officials who shall remain nameless, were accused of lying on their mortgage applications. Ok sure that goes on. It’s a crime to claim a 2nd home is your primary home. That’s fraud on the applicant. But what about the banks? What if the bank sells the note and separates it from the contract? What if the chain of title has been broken? There’s a 1872 Supreme Court Ruling called Carpenter v Longan that states, that once they have been separated, both become null and void. That means they both become broken, useless, and unenforceable, and this happens every single day. That is securities fraud. The bank responds by saying, “well we’re just doing what our policy is.” And nobody prosecutes it. But you can take advantage of it by challenging the bank on the chain of title analysis and gaining the release of the lien. Have you ever questioned whether your bank actually owns your mortgage — or just services it? What do you think would happen if you challenged the chain of title on your own home?
