The Ohio Board of Pharmacy is creating one of the most legally contradictory situations I’ve seen in the dietary supplement industry. Natural kratom leaf products are sold nationwide under federal dietary supplement law established by DSHEA and regulated through: • FDCA • DSHEA • 21 CFR Part 111 • 21 CFR Part 117 • 21 CFR 190.6 Yet Ohio regulators are effectively demanding retailers ignore or override federal dietary supplement law through state-level administrative action. So which law are retailers supposed to follow? Federal law? Or politically motivated rulemaking from unelected regulators? Even worse, Ohio’s public guidance has been inconsistent and confusing, causing compliant retailers to pull lawful products entirely while black-market operators continue unaffected. Instead of implementing: • age restrictions • testing standards • contaminant limits • labeling requirements • GMP enforcement …the Board chose regulatory chaos. This is what happens when regulators who do not understand DSHEA attempt to regulate botanical supplements like narcotics. They are not protecting consumers. They are driving compliant operators out of the market while strengthening underground sales. The solution is simple: Target synthetic and chemically manipulated compounds if warranted. But federally regulated natural kratom products manufactured under FDA dietary supplement law are an entirely different category. Ohio regulators know the difference. Some of you either genuinely do not know how to read scientific literature, or you’re intentionally being dishonest. The published data on 7-hydroxymitragynine is not ambiguous. The paper literally discusses its significantly stronger μ-opioid receptor activity and potency compared to morphine in multiple experimental models. This is not “anti-kratom propaganda.” This is the actual pharmacology. Natural kratom leaf and highly concentrated/synthetic 7-OH are not the same thing, and pretending otherwise makes the entire industry look unserious. You cannot scream “trust the science” while simultaneously ignoring peer-reviewed data because it is politically inconvenient. The receptor pharmacology is the receptor pharmacology. Fucking Morons

@greta Kratom can provide pain relief, but many users don’t realize the industry’s largest lobbying arm, the American Kratom Assoc, pushes back on real safety because it will reduce sales. As a result death and addiction climbs. Until this changes, more states will ban it.

Maybe you know more about this than I do..but this is what I do know: we should be talking about this…and make good decisions

I just read something INSANE this morning buried in a new bill, and I can’t believe more people aren’t talking about it. They want to give the IRS new powers to audit small businesses for up to 9 YEARS over ERC claims. That is unprecedented. Most businesses are not even required to keep records that long... The ERC program saved millions of jobs during COVID. Was there some fraud? Sure, like in any government program. But 95% of these businesses played by the rules and are still standing today because of that support. Now they want to go back and punish them? This is a WAR on small business. It is anti-growth, anti-entrepreneurship, and frankly, Anti-American.
