Justice Madlanga is a pragmatist. A forced witness is a silent witness. If the Commission denies the postponement, Matlala will just plead his Right to Silence on every question. Expect the evidence leaders to agree to a brief delay they need him singing, not stonewalling.

Adv. Chaskalson gets easily excited. What kind of case law is he relying on that says a person on sick leave is under house arrest or mustn’t been seen? South African law says no such thing.
Being seen at Woolworths or in a shopping mall is not proof of misconduct or dishonesty. The legal question is whether the person was medically unfit to perform their duties, not whether they were visible in public.
