.@AGToddRokita says Indiana's race and sex based contracting preferences are over. Today, he released a 40+ page advisory opinion concluding that the Minority and Women's Business Enterprise components of the state's DBE program violate the Equal Protection Clause of the 14th Amendment. Key highlights: • The program has been in place for 43 years. • Rokita argues the state should award contracts based on merit, not race or sex. • He says the program required spending goals for minority and women owned businesses and required contractors to submit plans showing how they would meet those goals or demonstrate "good faith efforts." • According to Rokita, businesses that failed to comply could face rejected bids, terminated contracts, withheld payments, or debarment. • He says the program relied on explicit racial and sex classifications that cannot survive constitutional scrutiny under the Equal Protection Clause. • Rokita points to the Supreme Court's Students for Fair Admissions decision as the legal foundation for his opinion, calling it one of the most significant Equal Protection rulings in decades. • He praised Governor Mike Braun for immediately accepting the opinion and ending race and sex based contracting goals. • He criticized the General Assembly for leaving the law in place despite multiple opportunities to repeal or amend it after recent Supreme Court decisions. • Existing state contracts will remain in effect, but future contracting will move to what Rokita called a "colorblind" process. • Veteran preferences will remain because they are not based on race or sex. Rokita called the move "restoring fairness under the law" and said his office will continue challenging DEI policies across Indiana government, including investigations involving several universities and state contracting practices.
