@ZloNoNameSov I mean... maybe it's a damn well-made orc camp. I don't know, I haven't played it myself
English

@DmitryDeceiver Hasn't heavy hearts been in development for 5 years now with nothing past the orc camp being done?
i swear I've seen it back in 2020 if not earlier.
English

Yeah. We're a swarm, we're one
Heavy Hearts Game (Dammitbird) 🔞@GalewindG
@DmitryDeceiver Considering your country of origin, i can see how you would likely have loyalty to Eans. I don't care to argue this with you, but I'm trying to present myself in good faith. I've maintained my position. Eans has been deleting theirs.
English

@GalewindG Unless I signed a contract that specifically says so, of course
English

@GalewindG By the way, please show me proof that she not only allows her art to be used, but also waives all rights to her own art? That's not the same thing, is it? If I allowed someone to put my art in their game, does that mean I don't have the right to my art
English

Artists, please don't do this.
- This person worked for me in the past and left the project for personal reasons.
- They have been thanked and paid in full for everything done.
- They even posted their other work on itchio for free for anyone to use as game assets.
When someone leaves a project, you have to maintain a consistent art style.
This is not plagiarism.

English

@GalewindG Another shitty take. Just because I care and know her is no reason not to defend her in this situation
English

@GalewindG Yes, she started it. I'd be angry too if someone were to trace my work without my permission.
She deleted her page surprisingly often before all this. She must have been training really hard. What kind of a shitty takedown is that? Deleted the page = destroyed the evidence...
English

@GalewindG Specifically, in the itch set, there isn't a single sprite you paid for. And we both know that (I know exactly every sprite she made for you for a fee)
English

@DmitryDeceiver @GalewindG It does if you own the assets being traced. If not then yeah that's a problem.
English

@CarnivoreKing88 @GalewindG Oh, yeah, they didn't buy that picture. It's another one by the same artist. I should have started with that
English

@DmitryDeceiver @GalewindG Why would you care if someone replicated the art style of art assets you have already bought for your project?
English

@GalewindG Also, why someone (wink-wink) report her and accuse her of plagiarism on Patreon? Yes, you don't like the whole situation, but she clearly didn't steal anything from you. It's so cynical to accuse an artist of plagiarizing something she drew herself. She needs to earn a living
English

They posted their work on itchio long before giving me permission to use it commercially. Back then, it was published as "weinende rose assets". I'm assuming that's the title of their abandoned game (that store page appears to be deleted)
These assets being published now include stuff that I paid them for.
The amount of deletion this person is performing, to include discord chats, is more evidence that their narrative is extremely faulty.
English

@GalewindG So she didn't "even posted their other work on itchio for free for anyone to use as game assets" then, huh?
She claims she agreed on the condition that you pay for these sprites separately, but she never received this payment, and you simply started using her work
English

@DmitryDeceiver Not a lie. Permission was given by the artist personally to me.
This person has a very unreliable narriative.
And now like a good dev, I've removed those assets.

@GalewindG "When someone leaves a project, you have to maintain a consistent art style. This is not plagiarism."
Depends on how you feel about tracing in your commercial project, I guess

English

@GalewindG N3 - Lie. Nowhere does it state that she allows her work to be used without permission. Here's what the artist wrote on her itch page:
(She was banned on patreon and itch for suspected plagiarism. I'm sure it's a coincidence...)

English

@AndrealphusGam1 @GalewindG Good advice: they banned this artist for using her own work without permission (published online = anyone can use it, that's logical).
They didn't pay for these sprites, but they did pay for others. Apparently, if you buy an original sprite from an artist = you own all of her art
English

@GalewindG Open a ticket with itch.io support if you have the invoices and contracts to prove that you paid for that work and it's legally yours.
If so they will remove the page and nuke his account.
