Why this contract is structurally bad (for Duke)
1. No buyout, no liquidated damages — by design
There is no clause that prices exit. None.
Instead, Duke relies on:
•exclusivity,
•non-contact promises,
•and a boilerplate “irreparable harm” recital (§ VIII.2).
Courts routinely treat that kind of recital as non-binding narrative, not evidence. You don’t get to declare irreparable harm into existence just by writing it down.

2. They tried to backdoor roster control through NIL
Multiple provisions explicitly prohibit:
•enrolling elsewhere,
•competing elsewhere,
•even initiating contact with other schools (§ VII.3, § V).
That’s not “brand protection.” That’s transfer restriction via private contract. Judges are extremely allergic to that, especially post-House.
If this were enforced as written, it would function like a non-compete for a student-athlete. That’s radioactive.

3. Duke’s own remedies section caps their upside
Look at § VI.2:
•No consequential damages.
•No lost profits.
•Total liability capped at what Duke already paid.
So even if Duke wins on breach, the contract itself limits recovery. That alone undercuts the “we’re losing something irreplaceable” story.

4. Termination clause admits the truth
Section III.2(h) literally says Duke can terminate the deal if he:
•enters the transfer portal,
•enrolls elsewhere,
•or signs elsewhere.
Translation:
The contract contemplates transfer and responds by cutting off payments — not by freezing the player.
That’s devastating to Duke’s injunction argument.

5. “Aid of arbitration” is a leverage play, not a remedy
Reading the complaint alongside the contract makes this obvious:
•Arbitration can only award money.
•Money is capped.
•So Duke asks the court to freeze him first.
That’s not preserving arbitration — that’s trying to manufacture leverage they didn’t contract for.
Courts don’t like being used that way.

Bottom line (no hedging)
•Duke overreached.
•They avoided a buyout to stay NCAA-clean.
•That choice left them with no clean enforcement mechanism.
•Now they’re trying to use injunctions to recreate one.
Judges usually shut that down.
So when you ask “do they basically get nothing?” —
Yes. At most:
•withheld future payments,
•maybe clawback of prepaid deliverables,
•and a precedent-setting loss that forces schools to rewrite these deals.
And honestly?
For a top-14 law school, this contract reads like something written to scare teenagers — not survive a courtroom.

Ava can do some stuff more efficiently that BTC but that's a pretty low bar. It still has a ceiling.
