@Popeye7746 So you think the court and interpretation of law is non-partisan? That’s what this post said. But yes, your hypothetical situation would be problematic and unfair. And absent affirmative action, that student may well be passed over for being the wrong color.

All these Supreme Court decisions are 6-3, but the court is supposedly non-partisan. Law is always subject to (and reified by) the interpretation of those in power.
