The role of an MCA is defined mainly in Articles 185 and 196, alongside supporting statutes like the County Governments Act.
An MCA is constitutionally required to:
1) Legislation - make laws for the county. The County Assembly passes Bills that, once assented to by the Governor, become county laws. These laws govern functions assigned to counties under the Fourth Schedule of the Constitution of Kenya, such as health services, agriculture, and county transport.
2) Oversight - HOLD the County Executive ACCOUNTABLE. scrutinize the Governor, County Executive Committee Members, and county departments. This includes reviewing expenditure, program implementation, and service delivery. They can summon officials and demand reports.
3) Representation - represent the interests of their ward. They articulate community needs in the Assembly, influence policy, and ensure resource allocation reflects local priorities. Public participation is mandatory under Article 196, so they must engage citizens in decision-making.
4) Budget Approval - approve county budgets and expenditure. The Assembly reviews and approves the County Fiscal Strategy Paper, budget estimates, and appropriation bills. No public money can be spent without Assembly approval.
5) Approval of Appointments - vet and approve key county appointments. This includes County Executive Committee Members and other senior officials nominated by the Governor.
6) Policy Influence - shape county policy direction. Through motions, committee work, and legislative proposals, MCAs influence how county functions are implemented.
7) Impeachment and Removal Processes - They can initiate removal proceedings. The Assembly can IMPEACH the Governor or REMOVE County Executive Committee Members under constitutional and statutory procedures.
In operational terms, the effectiveness of an MCA depends on three things:
a) Grasp of legislative procedure and committee systems
b) The ability to interpret budgets and audit reports
c) The engagement with citizens to ground decisions to real needs

The role of Senators under Article 96:
• Represent counties – Speak for their county at the national level.
• Make laws – Debate and pass Bills that affect counties.
• Oversee funds – Check how money sent to counties is used.
• Share revenue – Help decide how national funds are divided among the 47 counties.
Senators DO NOT run counties or MANAGE services like roads, hospitals, or schools. That’s the Governor’s job. Their POWER is in Parliament: making laws, protecting devolution, and holding the national government accountable on county matters.
