Papa laid the first brick to our house in 1995, I was 5, we moved into the house around 1998. At home we’ve known nothing else but love, laughter, discipline and prayer. My sisters agreed at the beginning of the year that we needed to give our lovely parents a home makeover. We prayed about it and we asked God to guide our steps. Our little one said she’ll cover cost of fundi food, the other said she’ll take furniture, the other curtains and the other all three gates and together we labored for four weeks and delivered. I handled the rest of the renovations, supervised and executed. For four weeks I’d be here to ensure all was done as planned. And all went smoothly and the outcome left me breathless. We’ve seen our parents happier but not how happy when the renovations were complete. I’m grateful to have my family, it’s all I have and everyday they continue to remind me how blessed I am. I’ve considered this makeover as my birthday present to my family. Cape Town can wait, this here is our home, and it’s warm, it’s beautiful, there’s love here, God resides here with us and it’s Enough. May our parents know nothing but joy and peace. May they know that we love them now and forever and may God grant us long life and good health to enjoy that which He has blessed us with~Family. Strategies to adopt in loan negotiations. 1. If you want to do a project, register a company. Don't do it under your personal name. In law, a company is a separate legal entity from its owners. 2. Before a bank approves a loan, it often satisfies itself on the adequacy of the underlying security. Often, they will ask for additional security or personal guarantee of the directors. This is where most of use get tricked. We provide security but also proceed to sign the personal guarantee. Big mistake- because when the company defaults, the charged property is often sold. If loan is not fully paid, the bank can legally sue under the personal guarantee, get judgment and proceed to execute by attaching the personal assets of the guarantor-which is often the matrimonial home. This is where you get clever, don't own your matrimonial home under your personal name. They will try to come for it. Own it under a company. When they look to attach, they will not find assets under your name. 3. Banks will try to get you-the way they did to Tuju, to provide your personal property as additional security for the lending. Don't ever do this. For Tuju, the bank must have asked him to charge his home and other properties to fully secure the entire Kshs. 1.2 billion. Then they play legal games-they disburse Kshs. 900 m -refuse to disburse the Kshs. 300 m for valid or invalid reasons (only Tuju knows- then they sue Tuju in London. The loan contract that Tuju signed usually contains a clause. It is a hidden clause but has huge legal implication. In London, they agree with the bank and then the judgment is later enforced in Kenya. Judges in Kenya cant re-open the case. But Tuju ties to sue. He looses at the High Court and Court of Appeal. Supreme Court judges refuse to hear the case. I am told Tuju accused the SC judges of corruption [ capitalfm.co.ke/news/2024/10/b… ] Bad move, if you ask me. Tuju badly needed the SC. If were him, I could have been humble like winter rat ! But it is what it is. This means, the bank proceeded to lawfully auction Tuju's personal properties that were covered under the charge instrument. Very unfair. But the law is the law. One must be clever and foresee all the legal risks in any transaction. The bank played Tuju and has lawfully auctioned his property despite that the Kshs. 900 m went to the primary property that the bank charged. Legal rules and principles-res judicata, doctrine of finality of litigation etc- are all against Tuju. I saw his letter to the CJ but the CJ cant help. The law is an ass ! May be Tuju needed legal strategists like Fred Ngatia. But it is too late to hire Ngatia. The case is at a stage where it cant be re-opened. Nothing Ngatia can do ! The law-what is the criteria of validity of legal rules and legal principles? Is justice one of them? No, lit looks like courts of law are not courts of justice. Self-evidently. Can Tuju stop the new owners from taking over his property ? Legally, he cant. The property has new owners.
