The court directed the Maharashtra government to pay Rs 10,000 as compensation to the 26-year-old petitioner. The court rejected the police claim that the search was conducted as part of the investigation into an offence, saying this could not justify ignoring mandatory safeguards laid down by the legislature. It said the investigating agency is expected to act strictly within the bounds of law, and the object of investigation cannot legitimise an otherwise illegal search or seizure. The petitioner, a resident of Saoner in Nagpur, told the court that police entered her house and bedroom illegally under the guise of investigating a case and seized her mobile phone without following the statutory procedure. The police said they had gone to her house to question her in connection with a car accident.
