Like Rodney Dangerfield, the second factor gets no respect. It deserves better. The Second Circuit’s Judge Pierre Leval, in Authors Guild v. Google, neatly summed up the view of nearly every court that has taken up a fair use question: “The second factor has rarely played a significant role in the determination of a fair use dispute.” At best, most fair use opinions devote no more than a couple of paragraphs to the second factor. authorsalliance.org/2026/02/25/res…

Let me assure the administration: Los Angeles City and County's elections are safe and secure. All Angelenos receive ballots in the mail, thousands have already voted, there is no need to vote in person so there is no need to send anyone to monitor our Vote Centers. For those few Angelenos who do vote in person they need not fear anything and they should not have to be in fear of their government. Washington DC—we got this!
