What she says here is absolutely true. Several years ago, a woman who was new to the fight said to me, "Surely, if you explain to a judge in a courtroom what is really going on here, you'll be able to get this fixed?" No. I explained to her that a US federal judge had at that time recently ruled that a lawyer was not permitted to use the word "male" in court when referring to a male athlete. A few years before that, a different US federal judge told a different lawyer that the lawyer was not allowed to use the phrase "opposite sex" in court because the judge found the phrase to be "complicated." It hasn't been like this in every case that's come up in the US, but it has been like this in nearly every one of them, including cases that are being presided over by conservative judges. "Gender cannot be questioned and cannot be defined. It is the black hole of legal theory" is brilliant.

The dogs need to be taken away tonight.

Universities should refocus on the great liberal texts on power (not least the Federalist Papers) and abandon their juvenile flirtations with Foucault and critical theory. bloomberg.com/opinion/articl…
