The High Court of Kenya has held that child offenders are special children of the law who cannot be subjected to the harsh punishment of permanent criminal records publishable on demand. Also see: legal lacunas vis avis Courts powers as the last bastion of human rights.

Kenya High Court orders expungement of a 20-year criminal record entered when the petitioner was only nine years old, holding that a child offender is a special child of the law and that proceedings concerning a child are geared towards reformation, not retribution. The Court emphasised that even where a child has been found guilty of an offence, it is undesirable that such a record be retained into adulthood because child offenders ought not to be treated like adult offenders, and maintaining such a record is contrary to Article 53(2) of the Constitution, which provides that a child’s best interests are paramount. In Patrick Kimathi v Inspector General of the Police Service & 5 Others [2026] KEHC 2918 (KLR), 25 Feb 2026) the petitioner challenged the continued retention of his fingerprints and personal data in the criminal records register for about twenty years after he had been charged in 2004 with housebreaking and stealing when he was about nine years old. The case was never determined, the court and police files could not be traced, and a letter from the Tigania Police Station later confirmed that the petitioner’s fingerprints had been erroneously submitted to the Criminal Records Office. Despite this, the record remained active and affected his ability to obtain a certificate of good conduct and secure employment. The High Court noted that there was no proof the case against the petitioner was finalised or that there had been a finding under section 14(2) of the Penal Code that he had the capacity to know that he ought not to have done the act or omission; therefore he ought to have been presumed not criminally responsible. The Court also relied on the undisputed police letter confirming that the alleged offence did not appear in any criminal register and that the petitioner’s fingerprints had been erroneously submitted. The Court held that maintaining the petitioner’s record was contrary to the spirit of Article 53(2) of the Constitution and violated his fundamental rights. Although the respondents argued that there was no legal framework permitting expungement of criminal records, the Court held that the absence of a specific law could not prevent the Court, as the last bastion of human rights, from granting relief where constitutional rights had been violated. The Court therefore ordered the expungement of the petitioner’s criminal record, directed the issuance of a certificate of good conduct, and awarded KShs 500,000 in general damages. The provision of the Children Act is very instructive on the right to privacy when dealing with children both in contact and conflict with the law.

Children born out of wedlock to a Muslim father are entitled to inherit his estate. In Fatuma Athman Abud Faraj v. Ruth Faith Mwawasi & 2 Others, the Supreme Court was asked whether Islamic succession rules could lawfully exclude such children. The case arose after the death of Salim Juma Hakeem Kitendo, a Muslim man who died intestate. Three women claimed to be his widows: Fatuma Athman, Ruth Faith Mwawasi and Marlin Coram Pownali. Each claimed a share of the estate for herself and her children, but Fatuma argued that only children born within a valid Islamic marriage could inherit. The Supreme Court held that although Muslim law applies in succession, it cannot override the Constitution’s guarantees of equality and the rights of the child. The Court held that children belonging to the deceased are entitled to inherit, regardless of whether they were born in or out of wedlock.

The High Court has held that no child should ever serve a prison sentence for their mother’s crime. When an expectant woman is taken to court, the court must first ask one question, what is in the best interest of this child? If jailing a mother will harm her child, then prison should not be the default. Judicial Officers MUST seriously consider non-custodial sentences on expectant women unless the offence is so grave that mercy would be unjust.

Hello @Educ_SportsUg & @Parliament_Ug , To give parents some relief, schools could consider adopting a semester based system with two main school terms per year. Each term would include a three week half term holiday, and a full term could be extended to about four and a half months. This approach would allow parents to spend more meaningful time with their children during longer recess periods, enabling them to guide them gradually into adult life while strengthening their moral values, discipline and sense of responsibility. Under this system, children would interact with their teachers for roughly nine months in a year and enjoy about four months of holidays. The extended breaks could reduce learner burnout, improve mental well-being and give families time to bond, mentor & expose children to real life skills beyond the classroom. This model could create a healthier balance between academic learning and family based upbringing, while still maintaining educational standards.
