@ProfMarkElliott Putting the rights and wrongs of this episode to one side, the HLCC 2014 report noted that the scope of the LC’s duties to respect the RoL are contested and ill-defined, albeit its report ultimately argues those duties extend beyond immediate ministerial responsibilities.

The notion that the Lord Chancellor,—whose responsibility for upholding the rule of law is acknowledged in statute—should exercise discretion in identifying ‘acceptable’ and ‘unacceptable’ breaches of the rule of law turns fundamental constitutional principle on its head.

Every time we reach a new low, further depths are then plumbed. The rule of law requires compliance with law, period—not just when Ministers find it convenient, and it certainly does not licence breaches of the law when Ministers judge that expedient. /...
