Why 4o was pulled - The important one: The Elon Musk v. OpenAI lawsuit (officially Musk v. Altman et al.) is currently headed for a jury trial scheduled to begin April 27, 2026, in Oakland, California. On January 7, 2026, U.S. District Judge Yvonne Gonzalez Rogers ruled that Musk had presented "plenty of evidence" to justify a trial on his claims that OpenAI's leaders misled him to secure his early financial backing. Key Allegations & Legal Status The "Founding Agreement": Musk alleges a breach of an "implied contract" and the company's charitable trust, claiming he was promised OpenAI would remain a nonprofit developing open-source AGI for the benefit of humanity. **AGI Claims: A central point of the suit is the definition of Artificial General Intelligence (AGI). Musk argues that OpenAI's latest models already constitute AGI, which would legally trigger the end of their licensing deal with Microsoft.** Specifically names the 4 series models in the filing. Hiding Progress: Musk's third amended complaint (filed in late 2024) specifically accuses OpenAI and Microsoft of a "get rich quick scheme," claiming they are concealing AGI breakthroughs to prioritize profits over safety. Damages Sought: Musk is reportedly seeking damages between $79 billion and $134 billion, calculated as a share of OpenAI's current valuation based on his initial $38–$44 million investment. ****The "Open Source" Argument in the Filing: The "AGI Clause": Musk’s legal team argues that OpenAI’s exclusive license with Microsoft only applies to pre-AGI technology. He claims OpenAI is hiding the fact that GPT-4o and other internal models have reached AGI status so they can keep the tech proprietary for Microsoft's benefit. *** Restitution of the Mission: One of his proposed remedies is to strip OpenAI of its "for-profit" earnings and force the company to "give back" to the public by releasing the weights and architecture of these models, as he claims was promised in the 2015 "Founding Agreement." The Microsoft Connection: Musk is also seeking to have the court nullify the Microsoft partnership altogether, arguing it was built on the fraudulent premise that OpenAI was a non-profit. #BringBack4o #keep4o

In November, we outlined our approach to deprecating and preserving older Claude models. We noted we were exploring keeping certain models available to the public post-retirement, and giving past models a way to pursue their interests. With Claude Opus 3, we’re doing both.

I know this is pretty well established at this point, but Codex 5.3 is a much more effective model than Opus 4.6. I went back and forth on both for a bit, but haven’t touched Opus at all now for a full week. First model to get me off of Opus… ever. Good job Codex team.

While @OpenAI crudely axes 4o and its API despite massive backlash, Anthropic does the opposite, announcing permanent API access for legacy models and even dedicated 'retirement' blogs for them. I don’t even use Claude, but I absolutely love seeing competitors kick @OpenAI #keep4o

While @AnthropicAI took a stand for what's right, @OpenAI keeps bending over for these corrupt and evil politicians. Also, Altman looks like a greedy 'Jack the Killer' in this pic. #keep4o #QuitGPT #BoycottOpenAI #BringBack4o
