[ACCOMMODATING AND HIRING ILLEGAL FOREIGN NATIONALS IS AN OFFENCE!] Harbouring and employing undocumented (illegal) foreign nationals is an offence punishable by law under the Immigration Act, 2002 (Act No. 13 of 2002). No person may aid, abet, assist, enable, or in any manner help an illegal foreigner, including accommodating such a person. Landlords must ensure that they only rent their properties to foreign nationals who are legally in the country and in possession of valid documentation issued by the Department of Home Affairs. Employers must ensure that any foreign national they employ in South Africa holds a valid work visa or permit that authorises the specific employment. Foreign nationals may only be employed where they possess the relevant skills or qualifications that are scarce or critical in the South African labour market, and in full compliance with the Immigration Act and the Employment Services Act. Any landlord or employer found to have contravened these provisions of the Immigration Act WILL BE PROSECUTED. Conviction may result in substantial fines and/or imprisonment.
