I see that both cases @highcourtofaus heard in Adelaide last week were five judge cases, and both had the same panels (with Edelman and Gleeson absent.) (I'm surprised Chaplin - a robodebt case - didn't merit seven judges.)

No surprise, despite some confident claims to the contrary being bandied about.

@jeremy_gans So there can never be an interlocutory appeal by a D when evidence they seek to lead is ruled inadmissible ?

"To the contrary, it was evidence that the applicant sought to have admitted to advance the defence case. Like the judge, we have therefore concluded that the interlocutory decision should not be certified."

I have just heard that Sir Anthony Mason died. In 2014, I was immensely privileged to be able to interview him. In his memory, I post this interview, and express my thanks for his immense contributions to the law of Australia. blogs.unimelb.edu.au/opinionsonhigh…

I must say that, if I had to use a limited number of words to describe Mason CJ's contribution to Australian life, it would not be limited to his limited role in the Whitlam dismissal.

(Lots of other sexual offence procedure provisions in this Bill.) (Also the abolition of trial by jury for offences likely to receive more than 3 years in prison and for some complex or lengthy trials.)
