
The Durban High Court has dismissed an application for leave to appeal by Calvin Mathibeli, ordering him to pay punitive costs.
Mathibeli had attempted to challenge a 27 February 2026 judgment that gave him 24 hours to remove defamatory posts about Nhlanhla Mkhwanazi from social media, websites, and other digital platforms.
The court also prohibited him from repeating the false allegations and held him liable for all legal costs. The ruling emphasised that the claims had the potential to seriously damage both Mkhwanazi’s reputation and the image of the police service in KwaZulu-Natal.
Mkhwanazi has welcomed the outcome, saying it serves as a strong warning to individuals who spread damaging accusations without evidence.
