We are disappointed that SCOTUS denied the petition we filed for the daughter of Ryan Stokes, who was unarmed and surrendering when an officer shot him from behind without warning. As Justice Sotomayor explains, the Court’s silence speaks volumes. supremecourt.gov/opinions/22pdf…

As this case demonstrates, the doctrine of qualified immunity must be reconsidered: it is atextual, ahistorical, impractical, and unjust. We therefore urge the Supreme Court to reexamine the doctrine or abolish it altogether.

Civil rights pltfs often can’t identify the gov’t actors who harmed them and sue “John Does.” If they ID the bad actor in discovery and try to amend the complaint after the SOL has run, most COAs say the amendment doesn’t relate back. Our brief explains why that’s wrong.
