This morning at Kibera Law Courts, Nairobi, I appeared alongside Hon. Eugene Wamalwa, Senator Dan Maanzo, Adv. Ndegwa Njiru, and other counsel in the matter of Hon. Raphael Tuju. Our submissions were grounded in Articles 49 and 25 of the Constitution; the rights of an arrested person, including access to medical treatment, and non-derogable rights that admit of no limitation whatsoever. We further submitted that no charge is properly before the court to warrant the actions taken against him. Notwithstanding our demands yesterday, Hon. Tuju was only conveyed to Karen Hospital this morning, a violation of his constitutional rights. The court has since directed that he be accorded full and proper medical attention, with the matter set for determination tomorrow.

Fellow Kenyans, The current situation facing our nation is a painful reminder of Kenya’s long and difficult journey toward justice, freedom, and true democracy. Our history is marked by moments of profound steadfastness and resilience, from the brutal crackdowns of the colonial era, where freedom fighters were detained, dispossessed, and executed, to the repression that followed independence as citizens continued to demand dignity, land, and political space. We have endured the dark days of single-party rule, the horror of torture chambers, the tragedy of ethnic and electoral violence, and the more recent Gen Z unrest that has shaken the conscience of our nation and the world. These chapters, though painful, are part of our collective story, a story not only of suffering, but of courage and an unyielding desire for a better Kenya. Let us remember: Kenya’s democracy is still evolving. It is young, tested, and at times fragile, but it is alive. And as history has shown us, even in our darkest moments, the spirit of the Kenyan people has never been extinguished. To all Kenyans, I say this: remain hopeful. Stand firm in your belief in justice, unity, and the rule of law. Let us reject despair It is always darkest before dawn. And together, we will see the light.
