
On April 6, 2024, in Scott, Louisiana, my client Anthony Wayne Babino Jr., 20 years old, was waiting to get $10 in cash from a friend so he could pay for his entry into the annual Scott Boudin Festival. While waiting, he was approached by Lieutenant Brun Lavergne of the Scott Police Department.
Without any justification to do so, Lavergne ordered Anthony and his friends to walk towards the festival. However, Anthony protested against having to move down a public street. Notably, Anthony was not impeding traffic nor was he loitering or prowling because he was waiting there to receive the money from a friend.
As Anthony walked away, Lavergne grabbed Anthony by the neck and placed him in a carotid hold for approximately 10 seconds. As you can see from the video, Anthony was in great physical distress and was on the verge of passing out due to loss of blood circulation to his brain.
The state of Louisiana has banned the use of choke holds and carotid holds.
