🚨Tim Heaphy and a Tale of Two UVAs: Upon Jim Ryan's resignation, Tim Heaphy penned a guest essay entitled " What the University of Virginia Should Have Done," which was printed in the New York Times on June 30th. Heaphy was UVA counsel from 2018 to 2022. In the essay, Heaphy writes, "Had I been university counsel last week, I would have advised my client to challenge what I believe to be a false allegation that the university’s policies are unlawful." Fast forward to September 8, 2025. Heaphy gives a lecture to the UVA Retired Faculty Association entitled, "Higher Education at a Crossroads, in Virginia and Beyond." Near the end of the lecture Q&A session, he was asked a question about equity at UVA. Heaphy responds, “I do think that the university historically has had some programs that cross the legal line. I think we have in certain schools or certain departments had numerical formulas. And that is against the rules. I think there were prior administrations, political administrations that made clear that they weren't going to enforce Title VI, Title VII, Title IX in that way. So I can't stand here and say that everything the university has done historically has been an adherence of that line.” Which is it? A false allegation that the university's policies are unlawful or has the university historically had some programs cross the legal line? The video was shared here a couple days ago. As of 11/11, the full lecture has since been removed by the UVA Retired Faculty Association -- in fact, every lecture in their entire library virtual library now says "Sorry. Because of its privacy settings, this video cannot be played here." Tim Heaphy is currently a part of Jay Jones's transition team. @0rf The Medical Examiner went on to cite a timeline of Officer Sicknick's exposure to chemical agents and noted that Sicknick was one of the officers who engaged the Capitol mob, specifically noting that "all that transpired played a role in his condition."

@0rf Here are the facts about Officer Sicknick's autopsy. The Medical Examiner in DC found that the cause of Sicknick's death was "acute brainstem and cerebellar infarcts due to acute basilar artery thrombosis," and ruled that the manner of death was "natural."

We need a reasoned discussion about how law enforcement gathers and assesses intelligence about domestic violent extremism in this country. That discussion should be unencumbered by politics or false characterizations of the committee's findings.

President Trump and his co-conspirators devised and pursued a multi-part plan and prevent the transfer of power. He incited the crowd on January 6 and failed to act during the riot, despite being urged to do so. He and his enablers bear primary responsibility for the attack.

As the committee's report, appendices, and transcripts set forth, law enforcement could have done more to gather, disseminate, and operationalize intelligence suggesting violence. Those shortcomings do not diminish the former President's culpability for the events at the Capitol.

I recently spoke to NBC News about law enforcement planning for January 6. Since that interview, some have used my comments to suggest that law enforcement could have prevented the riot. That is false The proximate cause of the attack on the Capitol was President Trump.
