This is spot on. Furthermore 2 USC 6628 says that a provider shall not be barred from notifying the Sargent at Arms through operation if any court order. Congress placed the responsibility on providers and courts, not DOJ. Insofar as it falls on providers, they’re being told to ignore court orders, so one way or another it’s at the feet of the court. It’s hard to square what happened with the court doing its actual job. These NDOs, when properly used, are a critically important law-enforcement tool that liberals and libertarians are always trying to eliminate. That gets harder to prevent when the judiciary seems to be saying that they just sign on the dotted line when presented with an NDO rather than scrutinizing its legal basis.

Separately, why didn’t this NDO application go to a magistrate judge? That is routine practice in most courts.

That’s an easy standard to meet when you’re investigating cartels and cybercriminals. Not so for United States Senators. If the Court didn’t have the relevant facts to meet the standards of the NDO statute, it shouldn’t have issued the NDO. Obtaining the application is key.

The focus on DOJ policy in this response is misplaced. The DOJ doesn’t police whether the DOJ complies with statutory requirements, the Court does.
