On August 20, 2024, Judge Ada Brown of the US District Court for the Northern District of Texas issued a ruling that strikes down the Federal Trade Commission’s (“FTC”) final rule (the “FTC Rule”) prohibiting the use of noncompetition restrictions in the workplace. Judge Brown held that the FTC exceeded its authority in issuing a non-compete ban and that the FTC Rule was “arbitrary and capricious.” The Court held that the FTC Rule is “unlawful” and set the FTC Rule aside on a nationwide basis. For anyone wondering if MLB will challenge or cancel Ohtani's contract: The answer is unequivocally no. There is a specific article in the collective-bargaining agreement that addresses this. And it's very clear: Deferred money is limitless -- even $680 million of $700 million.

Anyone looking for moral clarity can find it here. I don’t know this man, but you have to respect his straightforward talk. I wish university presidents would speak with similar eloquence and honesty. A must watch.
