There are several scholarly observations regarding this audio: 1.Dr. ʿArafāt issued a ruling while other qualified scholars were present and available before him, yet he did not refer the questioner to them. 2.At that time, Dr. ʿArafāt was young in age and knowledge for such critical and serious rulings. 3.The Libyan situation was complex and delicate, a matter that even senior scholars would find difficult to navigate. 4.The questioner was unknown in status and credibility; such a serious matter requires trust to convey reality accurately without distortion. 5.The fatwā was issued within seconds of hearing the question from this unknown individual. With the appearance of this audio, it becomes clear that Dr. ʿArafāt’s denial of Shaykh Nizār in the Sudan case was merely for confusion and manipulation of his followers – to throw dust in their eyes and distract them from the clear evidences against him, and to divert attention from the separatist callers of Aden. He issued a fatwā on the Libyan issue, one of the most complicated issues the Ummah has faced, and yet he criticized Shaykh Nizār’s fatwā concerning compliance with the ruler in Sudan, al-Burhān, to combat the rebellious Khārijites.
