#MortalKombat2 was a fun ride from start to finish. As a die-hard fan, this is exactly what I wanted to see. The writing, acting, and fight choreography leveled up significantly from the first film. There were a few plot points I wasn’t a fan of, but the future is bright. 👊🏾🙏🏾

When I negotiate revenue-sharing agreements with schools, I insist that full payment is due to players if they remain on the roster through the conclusion of the season and any postseason participation, even if they enter the transfer portal or otherwise depart from the program thereafter. That includes declaring for the draft. This should be non-negotiable. I generally oppose liquidated damage clauses, as they tend to look like unenforceable penalties rather than a reasonable estimate of anticipated harm. I'm watching Cincinnati v. Sorsby closely to see how the federal court rules on this specific issue. I will almost always redline "sole discretion" language and, at a minimum, convert it into "reasonable discretion." For morals clauses, I like to add that the harm must be substantial and material. I'm sharing this because I want to not only empower my clients, but all athletes and their representatives. Redlining is only part of the process. Being a proficient negotiator and leveraging established, trusted relationships is also very important in the process.

First — the salary cap may be legally dead. ⚖️ The attorneys who BUILT the House settlement just went back to a federal judge and asked him to strip the College Sports Commission of its power to enforce the $20.5M cap on NIL deals. A hearing is set for May 27. The people who created the rules are now trying to blow them up. Let that sink in. 💥

@ryanpmulvaney Fair point. Schools have to be smarter in drafting LD clauses. Nonetheless, contracts are entered into for a reason and can’t be flouted just because the portal exists. Interesting to see what happens next.

A monetary penalty indeed, and effectively a noncompete since UC would waive the liquidated damages but only if Brendan entered (and stayed in the) NFL draft. College athletes should absolutely redline LD provisions in draft rev share agreements. There are other ways to handle the concerns of schools. College athletes should not be penalized for availing themselves of their express rights afforded to them by the NCAA.

Brendan Sorsby's Motion to Dismiss UC's $1 million liquidated damages claim may be the first real judicial test of these provisions in school-direct #NIL deals post-House settlement. UC wants more than it paid him for "NIL rights" worth $2,500–$10,000 under Ohio's own statute. And UC offered to waive it all if he went to the NFL instead of a rival. That's not a damages clause. An update on the Nebraska-CSC arbitration: A hearing has been scheduled for Tuesday, sources tell @YahooSports. The 18 Nebraska football players, represented by Husch Blackwell and supported by the school, will argue that $1 million+ in rejected NIL deals should be permitted.
