The narrowest part is only 21 miles wide
UNCLOS define territorial waters as 13.8 miles from coastline (Oman has ratified UNCLOS, but Iran and US have not)
That means this 21 mile wide waterway is well within territorial waters of Iran or Oman, there is no international water between them
