@BonginoReport Just a reminder to Dan Bongino’s fans that Dan began life as a character I created in Minecraft. You’re welcome.

The @NewYorker profile of Dan Bongino by CNN's @eosnos is so predictable you could write it yourself without reading it. It *laments* that the new online/media ecosystem Bongino uses is built to prevent censors like Media Matters from banning ideas -- as if that's a bad thing.

4/ As a lawyer at the end of a brutal year of constitutional courtroom carnage, executive norm-shredding, & legislative cowardice, it is an honor to work with a handful of legal warriors and brave clients who will NOT be crushed and whose courage & excellence inspire me daily!

3/ I’m working to get full opinion up will link it, but bottom line is the @nytimes’ discovery and litigation misconduct was repeatedly called out by Justice Wood, and he threatens prompt sanctions if the paper doesn’t comply!! Kudos to @libbylocke who won this! @ClareLockeLLP

Luke 2:10-11 Then the angel said to them, "Do not be afraid, for behold, I bring you good tidings of great joy which will be to all people. For there is born to you this day in the city of David a Savior, who is Christ the Lord.” #MerryChristmas

It’s an attack on litigation misconduct. The @nytimes, in ongoing litigation with #projectveritas, obtained legal memos directly relevant to the legal issues, and published them after demanding a litigation stay. Read the opinion, not the media spin.
The Associated Press@AP

A judge has upheld an order preventing the @nytimes from publishing documents between Project Veritas and its lawyer and ruled it must immediately relinquish confidential legal memos. Publisher A.G. Sulzberger called it an attack on press freedoms. apne.ws/S2D6QCS

Public discussions of public issues, together with the spreading of information and opinion ... must have a freedom unabridged by our agents. Though they govern us, we ... govern them. Over our governing, they have no power. Over their[s] we have sovereign power. -A. Meiklejohn

Of the Times' journalism, the court noted: ... "''Hit and run' journalism is no more protected under the First Amendment, than speeding on a crowded sidewalk is permitted under a valid driver's license.'" #ouch.

A hard-fought victory by the indefatigable @libbylocke of @ClareLockeLLP, who frequently reminds the NYT that, contrary to internal belief, they are not the most powerful entity in the State of New York.

"[T]his is no defeat for the First Amendment," wrote the Court. "It would indeed be a Pyrrhic victory...if the Amendment's safeguarding of the media... were confused with the attempt to constitutionalize the publication of the private, privileged communication ...presented here."

"[T]he court's protective order does not act as an impermissible prior restraint on the Times. As important as the First Amendment's protection against prior restraints is, on the present facts, the erosion of the attorney-client privilege is a far more imminent concern."

The Times/corp. media argued prior restraint. Wrong. "The Times is perfectly free to investigate, ... publish, opine, expose or ignore whatever aspects of Project Veritas its editors in their sole discretion deem newsworthy, without utilizing [PV's a/c] privileged memoranda."
