1:15am: A mixed bag out there - rain for most, some sleet and snow mixing in especially in the interior. Heavier precipitation that develops a few hours from now will dynamically cool the atmosphere and snow will begin to develop throughout the area.

Hey #AppellateTwitter ! Jess is irreplaceable, but fwiw, our news sensibilities are similar (e.g. we agree demise of "passim" is fascinating). If you'd like to tell me about your practice, circuit splits, the best/worst of Latin legalese, etc, hit me up! jeff.overley@law360.com

A housekeeping note: today is my last with @Law360 . It's been an incredibly fun 11 years. I was never much of a tweeter, but I did enjoy eavesdropping here, especially on #appellatetwitter . Please hit up @JeffOverley with appellate news!

@nateraymond It's very smart of you, and coincidentally, my newest internal training workshop at my publication is about interviewing tips, and one of them is "if you feel woefully uninformed, one of the worst things you can do is pretend otherwise."

Best interviews I’ve done lately involve confessing to the subject I’m ignorant about their specialty. It’s worth sometimes admitting humility.

One thing sort of lacking in the Novavax data is how effective their vaccine is against protecting against *severe* cases from new strains. None of the cases were severe in the vaccine group, but sample size too small to draw much from that.

NEW: Federal judge (unsurprisingly) blocks Trump's "most favored nation" rule on drug prices, which would give the U.S. low prices relative to other wealthy countries.

@JeffYoung Nice story. Ms. Stanerson's advice to slap people who refuse to wear masks is good and barely hyperbolic, it's long past time for anti-maskers to be condemned, not just called irresponsible.

For anyone wondering: Biden's HHS secretary pick, Xavier Becerra, pronounces his name like Javier (HAH-vee-air).

@WrongHIPAA Hi WrongHIPAA, I'm a reporter working on a HIPAA story that will mention your account. I'm hoping to ask you a few questions, please DM me or email me at jeff.overley@law360.com if you have a sec. Thanks!

#VRBPAC. I guess the "B" is silent. Everyone's saying ver-pack while I've been saying verb-pack for years.

The case also asks Supreme Court to confirm that its recent June Medical decision (a partial win, at least, for abortion rights) eliminated a benefits-vs-burdens test for evaluating anti-abortion laws (thus allowing laws with few benefits, so long as they aren't too burdensome).

Rescheduling isn't very common. We don't know why it's happening, but there's a good chance that some justices are interested in hearing the case and are waiting for Barrett's confirmation to see what she thinks.

Mississippi's 15-week abortion ban, nixed by an appeals court, is probably the most-watched abortion case that the Supreme Court could soon hear. The justices have now, for the third time since RBG died, rescheduled discussion of whether to hear it. supremecourt.gov/search.aspx?fi…

@RxRegA @US_FDA I think I last watched an FDA hearing webcast on 11/9/16 (absurdly and bizarrely scheduled for the morning after the election!) and if the production value is even remotely similar nowadays we definitely need a better option.

Tweeps, any idea how we can get the @US_FDA advisory committee meeting(s) for COVID vaccine(s) to be televised? Most likely, the interest will far exceed the ability of the online webcasting that FDA usually does, even w/ an overflow link (which they’ve added for Oct 22 meeting).

There’s too much I don’t know to answer this: 1. Is this a national survey? 2. What’s the sample size? The gap b/w HRC’s results here are so big they’re not helpful. Her numbers were not good with Hispanics.
Jeff Overley@JeffOverley

@madrid_mike True but hasn't Quinnipiac had Biden performing a lot worse than other pollsters with Latinos? (see first screenshot from July). Also this 56-36 spread is much better for Biden than the 45-35 spread that Quinnipiac found in July (see second screenshot).

Biden is just about on par with where Clinton was among Black voters, BUT is leading 56-36 among Latino voters. Biden absolutely must make up the gap with Latino voters - something we’re paying *very* close attention to.

Lots of polls today. Quick thread on new Quinnipiac poll: At the moment Trump is losing. On job approval, on coronavirus response, on making people feel safe in their communities, and most of all, head to head with Joe Biden.

@pbreit @SarahKarlin It hasn't been disallowed (70K treated so far) and a downside some people see is that making plasma widely available has resulted in patients refusing to enroll in placebo-controlled trials that could've given us a sense by now of whether plasma works >>> google.com/amp/s/www.nyti…

Breaking FDA news in front of a White House Press Corp May be because Trump wants the credit here, but also strikes me as a good way for them to avoid the hardest hitting questions FDA reporters would throw.

Giroir also said commercial labs are processing majority of tests within 3 days. Today I called CityMD, an urgent care chain that sends test samples to lab giant Quest. A recorded greeting says results are taking "on an average 10 days, at minimum 7 days."
