Writing for the unanimous court, Justice Kagan says some language in Justice Scalia's 1994 opinion in Heck v. Humphrey may have "swept too broad." It did not consider, and was never meant to bar, purely forward-looking civil rights suits like Olivier's.

The Supreme Court agreed to hear Suncor v. County Commissioners of Boulder County today--a case about whether states/local governments can sue energy companies over damages caused by greenhouse gas emissions. It's another case SG Sauer's office urged the court to take.

The Supreme Court will consider whether to take up Steve Bannon's appeal at conference on March 6. Despite the Trump administration saying it intends to drop the case, Bannon's attorneys are pushing the justices to continue on and reverse the D.C. Circuit.

NOW: SG Sauer tells SCOTUS that DOJ has decided to drop the contempt indictment against former Trump advisor Steve Bannon. DC USA Pirro filed a corresponding motion in district court. Bannon was convicted & served 4 months in prison for defying a Jan. 6 Committee subpoena.

Sauer's had success with unsolicited briefs so far. The justices have taken up 3 cases he asked them to and granted a stay he supported. Two other requests remain pending, including the most recent targeting Colorado's universal pre-k program. news.bloomberglaw.com/us-law-week/so…

Trump trade advisor Peter Navarro was also convicted and sentenced to 4 months in prison for defying a similar subpoena. The Supreme Court declined requests by both Navarro and Bannon to step in and stay their prison sentences.

NOW: The Supreme Court will allow California to use a new map in this year's midterm elections designed to counter gains from Republican redistricting efforts in Texas. The California GOP and the Trump administration had asked the court to block it.
