Honourable Coltart, With due respect to your distinguished career as a lawyer, it is worth recalling that in Zimbabwe’s constitutional democracy, the law is made and enacted by the elected representatives of the people— Members of Parliament—among whom the vast majority are not lawyers. These lawmakers, not lawyers, are the true framers of the Constitution of Zimbabwe. You assert in your post [x.com/DavidColtart/s…] that section 328(7) demands a referendum for any amendment “the effect of which” extends an incumbent’s time in office, and that “no amount of propaganda gets round that clear provision.” Again, respectfully, this reading does not reflect the actual and unambiguous text of the Constitution. Section 328(7) provides, in full: “Notwithstanding any other provision of this section, an amendment to a term-limit provision, the effect of which is to extend the length of time that a person may hold or occupy any public office, does not apply in relation to any person who held or occupied that office, or an equivalent office, at any time before the amendment.” The wording is deliberate and precise. The premise is an amendment to a term-limit provision, not any amendment. Only once that premise is satisfied does the predicate—concerning the extension of time in office—apply. The two elements are logically inseparable: the consequence cannot be invoked unless the amendment first targets a term-limit provision itself. The Constitution of Zimbabwe (Amendment No. 3) H.B.1 Bill, 2026 does no such thing. It amends not a single term-limit provision. For the avoidance of any doubt, the clauses it seeks to modify in this regard—sections 95(2) and 143(1)—are not term-limit provisions at all. Section 328(7) therefore has no bearing on them. This is not a matter of semantics; it is a straightforward, faithful reading of the plain language of the Constitution. Parliament is fully within its constitutional authority to proceed. Zimbabweans deserve a debate grounded in the actual text of the law rather than in selective glosses upon it, for whatever reason!

I agree - but section 328(7) is clear that whenever an amendment “the effect of which” extends the time in office of an incumbent, then a referendum is necessary. No amount of propaganda gets round that clear provision of our Constitution. So yes amend the Constitution if you have a two thirds majority but if you want it to apply to current office holders then a referendum is mandatory.

It is very sad but predictable to hear from my followers that Zimbabwe’s biggest supermarket group, OK Zimbabwe, ha shut down the following branches: •Robson Manyika •Kuwadzana Express •Chitungwiza Town Centre •Glen Norah I am also told by industry insiders that six more branches will be closed very soon due to the collapsed economy triggered by the bogus local currency and public looting by Mnangagwa’s criminal cartels. We told Mnangagwa that his local currency project, which was not backed by anything except propaganda, would collapse the economy. The local currency was a project devised at Mnangagwa’s farm by his criminal cartel members to ensure they had an instrument to loot public funds. If Zimbabwe were a democracy or simply a country with the rule of law, Mnangagwa would be sitting in jail with his criminal cartel gang members. He is a criminal who has avoided jail because he is in power! These closures bring unemployment not only to OK Zimbabwe but also to downstream and upstream industries. Downstream industries are businesses that rely on OK Zimbabwe to sell their products, such as farmers, suppliers, and manufacturers of goods stocked in the supermarkets. Upstream industries are businesses that provide logistics like truckers that moved goods to OK Zimbabwe, packaging and maintenance service providers. As Zimbabweans, we must also reflect on whether we have the right people to take on this dictatorship and remove it by any means necessary or we will forever be tweeting and posting our misery on social media!
