Hoe? vrtnws.be/p.qEjBA8WWV

Correcte samenvatting?

@general_marcT Not a showstopper. The conditions are not cumulative, that's why there is an ICC arrest warrant against Netanyahu and Putin.

It is time to debunk some myths surrounding the Walhalla of International Law! 1⃣Can you enforce International Law? For those who weren't aware, there is no such thing as an international police nor a universal international court. So even when countries or leaders break so-called "international law", they do not go to jail. So enforcing international law is almost impossible. When it comes to superpowers, it is impossible. Also remember, at a certain moment at the end of the previous century, the US, followed by some parts of the Western world, became de facto the "global police force". It did not make everybody happy either! 2⃣Is a condemnation of breaking "international law" then meaningless? It is not if your money is where your mouth is. In the #Venezuela case, I would argue that the sovereignty of a country has been violated, which is a violation of international rules. That is true in theory. But the real world does not care about theory. So you can condemn it, but if you do not have the means to back up your condemnation, it is irrelevant and maybe even a further proof of your irrelevance. 3⃣Is the #Venezuela case particular or just another case of breaking international rules in a long list of incidents? Breaking international rules is something that happens very regularly by different geopolitical actors (ask @grok 😉). The phrasing is of course particular interesting in the context of information warfare. 4⃣Is "International Law" universally recognised in the world? If you want to read the real world, you must not do it through the lens of international rules, but through the lens of national interests, power and power competition. International rules must be considered, at best, as a dampening factor. Do not forget, for a large part of the world, international rules have been a "Western invention, to maintain their power and condemn African countries". So do not be too romantic about them! These 4 bullets may look like cold and cynical but I think they are not. Any sound policy must be based and developed on reality and the cold facts. Accepting reality is still a challenge for a significant part of the (West) European public opinion. But let it sink in and keep them in mind when you talk about #Greenland !

@general_marcT Is this information AI generated? Because enforcement of it's rulings are more than "purely a political matter for the UN Security Council".

@KRLPeeters on the ICJ: "While its judgments are binding on the parties and final, the ICJ possesses no formal enforcement mechanism. Enforcement of its rulings is ultimately a political matter for the UN Security Council, where it is subject to the veto power of the five permanent members."

@general_marcT Venezuela is (still) a state party based on my information. And it's also blue on your map. Is your information AI generated? Because it surely sounds so, and it sounds very basic while reality is more complex.

On the ICC: "The ICC can generally exercise jurisdiction in cases where the accused is a national of a state party, the alleged crime took place on the territory of a state party, or a situation is referred to the Court by the United Nations Security Council." State parties (those in bleu of course).👇👇👇👇

@general_marcT There is an International Court of Justice (ICJ), which has already condemned US intervention in Nicaragua in '86 for example. Other than that, all states can take appropriate action against breaches of international law including but not limited to countermeasures, sanctions etc

@Fgandoul Nice quote but it seems to be stating the obvious. Why would something as common as regime change lead to a voiding of foreign debt of the state? It's a retorical question because it does not.

"If China successfully enforces a single contract claim against a post-Maduro government—just one—they’ve established that American regime change doesn’t void Chinese debt"
Shanaka Anslem Perera ⚡@shanaka86

China just declared war. Not with missiles. With lawyers. “Chinese interest in Venezuela will be protected by law.” Read that again. Beijing didn’t threaten military action. They announced something far more dangerous to American power: They’re going to make regime change uninsurable. Here’s what 99% of analysts are missing: This isn’t about $19 billion in Venezuelan loans. This is about $1.3 TRILLION in Belt and Road debt across 150 countries. Every dollar China has lent to Africa, Asia, Latin America, the Pacific—all of it is secured by the same legal fiction: that sovereign leaders can sign contracts that successor governments must honor. The US just kidnapped a sitting president from his bedroom and flew him to Manhattan. If that precedent stands, every Belt and Road loan is worthless paper. Every port deal. Every railway. Every power plant. Gone. China’s Foreign Ministry didn’t issue a protest. They issued a statement of existential necessity. They WILL pursue international arbitration. They WILL invoke bilateral investment treaties. They WILL take this to every court from The Hague to Singapore. They WILL make the legal cost of American regime change so catastrophic that the next president thinks twice. Not for Maduro. For the entire architecture of Chinese overseas lending. Trump told Fox: “There won’t be a problem with Xi.” Xi just answered: There will be 10,000 lawyers. Watch the next 90 days. If China successfully enforces a single contract claim against a post-Maduro government—just one—they’ve established that American regime change doesn’t void Chinese debt. That’s not a victory for Venezuela. That’s a restructuring of global power. The 21st century won’t be decided by aircraft carriers. It will be decided by who writes the contracts. And who can enforce them after the coup.
