Marco Rubio can't even make an honest case for attacking the International Criminal Court. He makes it sound like the ICC acts out of the blue anywhere it wants when in fact it acts only against crimes committed on the territory of states that have invited it. He never explains why the United States should be able to commit crimes on the territory of those states with impunity, contrary to the desire of their sovereign governments for an international backstop to reinforce justice for such crimes. Rubio even misconstrues my comments. I had noted that Trump should be charged for obstructing justice. His sanctions against ICC personnel clearly do that, and the court has jurisdiction because the cases he tried to obstruct, implicating U.S. and Israeli personnel, stemmed from the court's jurisdiction over crimes on the territory of member states (Afghanistan and Palestine). IF the court were to act, all 125 member states would have a duty to arrest Trump were he to dare show up on their territory, just they way Putin's and Netanyahu's travel is no constrained.
