REGARDING LINQTO:
Judge Perez just issued his ruling. THE BANKRUPTCY SETTLEMENT PLAN HAS BEEN CONFIRMED & APPROVED.
In his ruling, Judge Perez cited a very handsome attorney when he said:
“As Mr. Deaton likes to say: ‘Customers won Constructive Trust without litigating it.’”
Judge Perez also stated that the Liquidating Trust (LT) & Closed End Fund (CEF) is the result giving customers the closest possible option providing them “the benefit of their bargain.”
The Judge also stated that there were serious allegations of fraud at Linqto and that based on the evidence presented, the bankruptcy filing was done in good faith.
He overruled any objection to approving the plan. He stated that there were no conflicts of interests that impeded the plan and that the fact that the New Management at @linqtoinc is NOT involved in managing either the LT or CEF and made a claim themselves against the estate, proves no conflict impeded or improperly influenced the plan.
Being in bankruptcy sucked and it’s extremely unfortunate. But let me repeat what I’ve said before. There was more than $1 Billion dollars of value on the platform. Bankruptcy was filed July 2025. To get this case resolved in 7 months with customers estimated to receive 95% of what they’re entitled to - is the best bankruptcy result involving a fraud case in modern bankruptcy history.
Lawyers at Brown Rudnick, including Ken Aulet, Robert Stark, @stephendpalley and others, deserve most of the credit for putting customers first - above their own financial interests. They are outstanding lawyers who helped restore my own faith in my profession. Sam Schwartz and Jeff Stein who represented the debtor also deserve credit for putting customers first.
To all the innocent Linqto customers - congratulations on getting the best possible outcome in a shitty situation.
